OFFICIAL CONTEST RULES
1. ELIGIBILITY:
- You, the Entrant, must be a follower of Fluance on Facebook to submit an Entry or to vote. Click here to go to the Fluance Facebook page.
- You must be18 years of age or older at the time your Entry is made.
- You may be a resident of the continental U.S. (except for residents of Alaska, Hawaii or Puerto Rico) or Canada (except for residents of Quebec). Contest is void where prohibited or restricted by law or regulation.
- Circus World Displays Limited staff and members of their immediate families, including household members, may not make Entries for this Photo Sharing Contest.
2. HOW TO VOTE:
- To vote for an Entry, “Like” a photo on Facebook, “Tweet” the image to @Fluance on Twitter or “Repin” the design to the Fluance “Best in Home Theater” Photo Sharing Contest Pinterest board.
- You may vote for as many Entries as you wish, but you can only vote once for any Entry.
- Voting ends at 11:59:59 PM EST on June 30, 2013.
3. HOW TO ENTER:
To enter the Contest, you must follow these steps:
- “Like” Fluance on Facebook to be eligible to enter the Contest;
- Read and agree to the Contest Rules of the Contest on the Fluance Facebook page;
- Fill out the entry form and upload an image to the Contest on the Facebook contest page;
- You may enter only once to qualify as a finalist;
- Entries begin at 9:00:01 AM EST on MAY 3, 2013 and ends at 11:59:59 PM EST on MAY 31, 2013, so your Entry must be received before then
- Winning entries are subject to verification and approval of the Sponsor
4. CREATIVE AND TECHNICAL GUIDELINES:
Your Entry must follow these Guidelines:
- A digital photo image of your home theater system;
- The photo must be a minimum of 500 x 500 pixels and a maximum of 1500 x 1500 pixels.
5. A QUALIFIED ENTRY:
To qualify to win this Contest your Entry:
- Must be completely your original photo;
- The Entrant must be in the photo image;
- The photo must be appropriate for posting on a public website; photos that are considered obscene, provocative, defamatory, or inappropriate in any way will not be considered;
- May not contain any stock images;
- May not have been previously entered or used in any other contest or Contest in whole or in part or offered for sale;
- May not be a collaboration with another person;
- May not infringe the copyrights or trademarks rights of any third party;
- May not contain the name and likeness of another person unless he or she will and can sign an appropriate release for the unconditional use of his or her name and likeness;
- Must be submitted to the Fluance Facebook page on or before 11:59:59 PM EST on MAY 31, 2013.
6. YOU REPRESENT AND WARRANT:
By submitting an Entry, you represent and warrant:
- That you have the absolute and unrestricted right to submit the Entry as your sole work under the Contest Rules of the Photo Sharing Contest;
- All images of people or names of people that appear in the Entry, if any, have unconditionally granted to you the right to use their respective names or images for the Entry without any additional compensation to be paid for those rights and you will produce a signed grant on request;
- The Entry and every part of the Entry does not infringe on any intellectual property rights or other property interests of any other person, company or enterprise.
7. SUBMISSION OF RIGHTS:
All Entries will become the property of the Contest Sponsor and will not be acknowledged or returned.
If your Entry is selected as the winner, you will automatically grant to Fluance and CWD, for a period of ten years, the following rights:
- the exclusive right to use the Entry as a design for and on goods or services including the right to use the Entry to promote the goods or services on which it is used and/or to use the Entry to promote Fluance itself anywhere in the world and in all media;
8. SELECTION OF THE WINNER AND PRIZES:
The prizes cannot be substituted for cash or other substitutions, except as determined by CWD, who reserves the right to substitute a prize with another of equal or lesser value if the prize is not available for any reason as determined by CWD in its sole discretion.
Each Entry, once submitted, will be available for voting immediately;
Entries will be available for voting starting June 1, 2013 through to June 30, 2013– any Entries submitted after May 31, 2013 at 11:59 PM EST will not be considered;
Voting on Entries will be measured by the number of “Likes” on Facebook, “Tweets” on Twitter or “Pins” on Pinterest during the voting period of June 1 through 30, 2013 at 11:59 PM EST.
One vote per Facebook user per day is allowed;
Voting will be frozen and tabulated on June 30th, 2013 at 11:59 PM EST.
The winner will be notified on July 2nd at 12:00:01 PM EST.
If a Canadian resident wins a prize, that person must also answer correctly, within a 5 minute time period, a mathematical skill-testing question.
9. GENERAL:
The Photo Sharing Contest is void in any place where it may be prohibited or restricted by law and will remain available elsewhere in the event a specific jurisdiction restricts it. Fluance and CWD are responsible for conducting the Photo Sharing Contest under these Contest Rules but will not be responsible for any liability or damages that result to or from any computer, computer system, delay, mistakes or failure in the availability of the website to receive Entries or to receive and tabulate votes. Fluance and CWD reserves the right, in their sole discretion, to modify, cancel, terminate or suspend the Photo Sharing Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond its reasonable control corrupt or affect the administration, security, fairness or proper conduct of the Photo Sharing Contest.
This sweepstake is subject to Canadian and U.S. federal, state and local laws and regulations. All federal, state, local and provincial taxes and all income and any other taxes, fees and surcharges will be the sole responsibility of the prize winner.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS DESIGN CONTEST OR ITS VOTING PROCESS IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, Fluance RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW AND TO DISQUALIFY ANY ENTRIES SUBMIT BY SUCH AN ENTRANT.
In the event any Entry is found to be fraudulent or an unlawful appropriation of the work of another or in violation of any representation made in connection with the submission of the Entry, Fluance reserves the right to pursue any and all remedies against the member responsible for such an Entry.
